The short version. MedCare360 helps you find hospitals and doctors in India, compare treatment costs, get a second opinion, and keep your health records in one place. We coordinate care — we are not a hospital, we do not employ doctors, and we do not practise medicine. Every diagnosis, prescription and treatment decision is made by the doctor or hospital you choose, not by us. If you think you are having a medical emergency, do not use this site — call your local emergency number or go to the nearest emergency department.
1. Who we are and what these terms cover
MedCare360 (the "Platform", "we", "us" or "our") is operated by Vibudha Wellness Private Limited, a company incorporated in India under the Companies Act, 2013.
These Terms and Conditions ("Terms") are a legally binding agreement between you and Vibudha Wellness Private Limited, governing your use of medcare360.ai, its sub-domains, the Patient Portal and the Doctor Portal (together, the "Platform"). They apply to every visitor, registered patient, doctor and hospital using the Platform.
These Terms should be read together with our Privacy Policy, which explains how we handle your personal and health data and is incorporated into these Terms by reference.
2. Key terms
- Patient User — an individual who registers on the Platform to research, plan or manage their care, including a parent, guardian or authorised representative acting for them.
- Practitioner User — a doctor or other healthcare professional registered on the Doctor Portal, who in India must be a Registered Medical Practitioner enrolled in the National Medical Register or a State Medical Register.
- Facility User — a hospital, clinic or other healthcare establishment listed on the Platform.
- Healthcare Provider — Practitioner Users and Facility Users, collectively.
- Services — the functions described in Section 4: information services, provider discovery, cost estimation, AI-assisted tools, record storage and care coordination.
- User Content — anything you upload or submit, including reports, images, reviews and messages.
3. Accepting these terms
By creating an account, ticking the acceptance box, or otherwise using the Platform, you confirm that you have read, understood and agree to be bound by these Terms and by the Privacy Policy. If you do not agree, you must not register for or use the Platform. If you accept these Terms on behalf of a hospital, clinic or other organisation, you confirm you have authority to bind that organisation.
4. What MedCare360 does — and does not do
4.1 What the Platform provides
- Health information library — plain-language content on conditions, treatments and procedures.
- AI symptom checker — an automated tool that suggests possible causes for symptoms you describe and whether they may need urgent attention.
- Provider discovery — searchable profiles of doctors and hospitals, including credentials, specialties, location and patient ratings.
- Cost calculator — indicative price ranges for treatments and procedures, based on information supplied by Healthcare Providers.
- Insurance policy analyser — an AI-assisted tool that reads a policy document you upload and summarises its coverage in plain language.
- Health record storage — a personal space in your patient account to store prescriptions, reports and discharge summaries, and to control which doctors can see them.
- Care coordination — assistance with appointment scheduling, doctor-authored care notes, aftercare follow-up and, where you are travelling for treatment, help with hospital paperwork and visa invitation letters.
- AI health assistant — an AI tool, available inside your patient account, that answers questions using your own stored health records so you can better understand your own information.
4.2 What MedCare360 is not
MedCare360 is a technology and care-coordination platform. We are not a hospital, clinic, pharmacy, diagnostic laboratory or insurer, and we do not practise medicine, diagnose, prescribe or deliver treatment. No doctor–patient relationship is formed between you and MedCare360. Any clinical relationship exists solely between you and the Healthcare Provider you choose. Diagnoses, prescriptions, procedures and their outcomes are the sole responsibility of the treating Healthcare Provider.
The Platform is not for medical emergencies. If you believe you or someone else may be experiencing an emergency, stop using the Platform and contact your local emergency number or go to the nearest emergency department immediately.
Under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, MedCare360 acts as an intermediary for listings, profiles, reviews and other content published by Healthcare Providers and patients. We carry out the credential checks described in Section 9, but we do not independently verify every clinical claim a Healthcare Provider makes on their profile.
5. Symptom checker, cost estimates and other AI tools
- The symptom checker is an informational and triage-support tool only. It does not provide a diagnosis and is not a substitute for assessment by a qualified doctor. Its output may be incomplete or wrong. You must not delay or disregard professional medical advice because of anything it tells you.
- The insurance policy analyser produces a summary to help you understand a policy document. It is not financial or insurance advice, and the terms of your actual policy always govern. Confirm coverage directly with your insurer before relying on it.
- The AI health assistant answers questions using the records you have chosen to store in your account. It is a convenience for understanding your own information, not a clinical opinion, and it does not replace advice from your treating doctor.
- Prices and price ranges shown through the cost calculator, including any comparison or savings figure, are indicative estimates supplied by or derived from Healthcare Providers. They are not offers, quotations or guarantees. A binding price arises only when a Healthcare Provider issues you a written estimate or invoice directly. Actual cost depends on clinical assessment, the procedure ultimately performed, length of stay and other factors specific to your case.
- Where an automated feature produces a result that materially affects you, you may ask us for human review — see our Privacy Policy for how.
6. Eligibility and your account
To register you must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872, and, if registering as a Healthcare Provider, hold every registration and licence required to practise or operate lawfully in India.
A parent or lawful guardian may create an account and use the Services on behalf of a child or a dependant in their care. If you do this, you confirm you have the authority to share that person's information with us and to make arrangements on their behalf, and you accept these Terms for them as well as for yourself.
You are responsible for keeping your account details accurate and your login credentials confidential, and for all activity carried out under your account. Notify us immediately at support@medcare360.ai if you suspect unauthorised access to your account.
7. Acceptable use
You must use the Platform lawfully and respectfully. You must not upload, publish or transmit content that:
- belongs to another person and to which you have no right, or is invasive of another person's privacy;
- is obscene, harassing, or discriminatory on the basis of gender, race, religion, caste, disability or any other protected characteristic;
- infringes any patent, trademark, copyright or other proprietary right;
- is false or misleading and published to cause injury, or impersonates another person or a professional qualification you do not hold;
- threatens public order or the sovereignty and integrity of India, or incites any offence;
- contains malicious code intended to disrupt or damage the Platform; or
- advertises the diagnosis, cure or treatment of any condition in a manner that would breach the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954.
You must also not scrape, crawl or bulk-extract content from the Platform; attempt to reverse engineer any part of it; probe or test its security other than through the responsible disclosure process described in our Privacy Policy; circumvent access controls or rate limits; or post fake or incentivised reviews.
8. Using the Platform as a patient
- Provide accurate and current information about your symptoms, history, allergies and medication — clinical safety depends on it — and upload legible copies of reports and prescriptions when a doctor asks for them.
- Follow the instructions of your treating Healthcare Provider, and consult them before changing, stopping or starting any treatment.
- Do not use the Platform for a condition that requires emergency treatment or an immediate physical examination.
- Profiles of Healthcare Providers are compiled from information they supply and the verification checks described in Section 9. Ratings and reviews reflect the opinions of individual users, not our assessment of clinical quality. We may decline to publish or may remove a review that breaches Section 7 or discloses another person's health information without consent.
- Where you choose to travel for treatment, we may assist with hospital admission paperwork and requesting a medical visa invitation letter from the treating hospital. A visa invitation letter is not a visa and does not guarantee one will be granted — that decision rests entirely with the relevant immigration authority. You are responsible for your own passport, visa, travel insurance and fitness to travel.
- Aftercare check-ins and follow-up reminders are coordination services, not continuous clinical monitoring — no one is watching your data in real time, so do not rely on them to detect a deterioration in your condition.
- You may upload and store prescriptions, reports and discharge summaries in your account and choose which doctors can view them. You control that sharing and may withdraw it at any time, although a doctor may separately be required by law to keep their own copy of records they created.
- Information about insurance products and government health schemes on the Platform is general and may change without notice. We do not sell insurance and do not determine eligibility for any scheme — confirm coverage directly with your insurer or the administering authority.
9. Doctors, hospitals and the Doctor Portal
If you register as a Practitioner User or Facility User, you confirm, on a continuing basis, that:
- you (or, for a facility, every clinician who treats patients introduced through the Platform) hold every registration, licence and accreditation required to practise or operate lawfully in India, including — for doctors — enrolment in the National Medical Register or a State Medical Register;
- your registration is current and not subject to suspension or a pending disciplinary proceeding, and you will tell us promptly if that changes;
- every qualification, specialty and outcome statistic on your profile is true and verifiable; and
- you will comply with the professional conduct regulations of your regulator.
We verify credentials at onboarding and periodically thereafter against the relevant registers and accreditation bodies. This is a due-diligence step for the benefit of patients — it does not transfer clinical responsibility to us, and it is not a guarantee of your competence, conduct or outcomes.
Clinical responsibility sits with you. You are solely responsible for the clinical care you provide, including diagnosis, treatment, prescribing and record-keeping. MedCare360 provides infrastructure and coordination. It does not supervise, direct or review your clinical decisions.
Doctor Portal accounts must be issued to named individuals, not shared across a department, and you must access only the records of patients under your care. Facility Users are responsible for the accuracy of every price and package they publish, and must honour a published price for a patient who books through the Platform, subject to clinically justified variation disclosed in writing before it is incurred.
Fees, commissions, settlement cycles and the commercial terms of your relationship with us are set out in your signed empanelment or listing agreement, not in these Terms. Where a signed agreement conflicts with these Terms, the signed agreement prevails for that category of user.
We may suspend or remove a listing where we become aware of a lapse in registration, a credible patient-safety concern, a pattern of substantiated complaints, or a direction from a regulator or court. Where circumstances allow, we will tell you why and give you a fair opportunity to respond.
10. Content and intellectual property
The Platform, its software, design, database, health information library and AI models are owned by MedCare360 or its licensors and are protected by copyright and other intellectual property laws. We grant you a limited, revocable licence to access and use the Platform for the purposes these Terms permit — nothing more.
You retain ownership of your User Content. You grant us a licence to host, store and display it to the extent necessary to operate the Platform and provide the Services, including publishing reviews and ratings you post. We may use aggregated and de-identified data derived from Platform activity to improve the Services — this data is stripped of identifiers and cannot reasonably be traced back to you. We do not use your personal data to train third-party general-purpose AI models.
11. Third-party services and links
The Platform links to and works with third parties, including cloud hosting and messaging infrastructure providers. We do not control these third parties and are not responsible for their content, availability or privacy practices. Your dealings with a third party are between you and them directly.
12. Disclaimers
The Platform is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted or error-free. We make no warranty about the clinical quality, safety or outcome of any treatment, or about the competence or conduct of any Healthcare Provider, and no warranty about the accuracy of health information, AI tool output, cost estimates or provider-supplied data. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded.
13. Limitation of liability
Subject to Section 12:
- We are not liable for any act, omission or outcome of any Healthcare Provider or other third party.
- We are not liable for indirect, incidental or consequential loss, or for loss of profit, data or opportunity.
You acknowledge that these limits are reasonable given that MedCare360 is a facilitator of care coordination rather than a provider of treatment.
14. Indemnity
You agree to indemnify MedCare360, its officers and employees against claims, losses and reasonable costs arising from your breach of these Terms, your User Content, or — for a Healthcare Provider — any claim by a patient relating to treatment you delivered or failed to deliver.
15. Suspending or closing an account
You may close your account at any time through account settings or by writing to support@medcare360.ai. Closure does not cancel a confirmed appointment or relieve you of amounts already due, and does not require us to delete records we are legally obliged to keep.
We may suspend or terminate your access, with or without notice depending on the seriousness of the circumstances, where you breach these Terms, we have a security or fraud concern about your account, you provide false information, a regulator or court directs us to, or your conduct endangers a patient or our staff.
16. Governing law and disputes
These Terms are governed by the laws of India. Before commencing any court proceeding, you agree to raise the matter through our grievance process (Section 17) and give us thirty days to resolve it — most issues are settled at this stage. Subject to that, the courts at Bengaluru, Karnataka shall have exclusive jurisdiction.
Nothing in this Section takes away your rights as a consumer under the Consumer Protection Act, 2019, including your right to bring a complaint before the appropriate District, State or National Consumer Disputes Redressal Commission.
17. Grievance redressal
If something goes wrong, tell us at support@medcare360.ai and we will try to put it right — we acknowledge a grievance within 24 hours and aim to resolve it within 15 days. This is our grievance mechanism under Rule 3(2) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the Consumer Protection (E-Commerce) Rules, 2020. If you remain dissatisfied on a data protection matter, you may complain to the Data Protection Board of India.
18. Changes to these terms
We may update these Terms to reflect changes in law, regulation or the Services. We will publish the updated Terms with a new effective date, and for a material change we will give at least thirty days' notice by email or in-Platform notice before it takes effect. Continued use after that date means you accept the change. If you do not accept it, you may close your account before it takes effect.
19. Notices
We may contact you by email, SMS or in-Platform message about your account, appointments, security and changes to these Terms — these are service communications and cannot be opted out of while you hold an account. Marketing communications require your separate consent and can be withdrawn at any time. Legal notices to us should be sent to support@medcare360.ai.
20. General
Force majeure. Neither party is liable for a failure caused by an event beyond its reasonable control, including natural disaster, epidemic, war, or failure of telecommunications or power.
Severability. If a provision of these Terms is held invalid, it will be modified to the minimum extent necessary to make it enforceable, or removed, and the rest continues in force.
Waiver. A delay in enforcing a right under these Terms is not a waiver of it.
Assignment. You may not transfer your rights under these Terms without our written consent. We may assign them to a group company or in connection with a merger or sale of assets.
Entire agreement. These Terms, together with the Privacy Policy and any signed agreement with a Healthcare Provider, are the entire agreement between us on this subject. Headings are for convenience only.
